Terms of Use – NexLens Calc
These Terms of Use set out the rules and conditions for using the NexLens Calc application, developed and made available by NexLens Soluções Ópticas Ltda, a Brazilian limited liability company, headquartered in Brazil ("NexLens"). By using our app, you agree to these Terms of Use. If you do not agree, please do not use the application.
1. License to Use NexLens Calc
NexLens grants you a limited, non-exclusive, non-transferable and revocable license to use NexLens Calc in accordance with these Terms of Use and applicable laws. You may not use the application for any illegal or unauthorized purpose, nor may you violate any applicable laws or regulations.
2. User Account, Authentication and Cloud Access
NexLens Calc does not require the creation of a user account, permanent registration, or user profile for its standard operation. The Application may be fully used without any form of login or personal identification. Optionally, the User may authenticate through a One-Time Password (OTP) mechanism solely for the purpose of accessing NexLens Cloud, which allows synchronization and retrieval of the User’s data across different devices. This authentication method does not result in the creation of a permanent account, username, or password. The OTP-based authentication is temporary, session-based, and limited to enabling cloud access. The User remains solely responsible for all actions performed during an authenticated session and for maintaining the confidentiality and security of any access credentials or devices used to receive the OTP. The User agrees to promptly notify NexLens of any suspected unauthorized access, misuse, or security incident related to cloud access or authenticated sessions. NexLens shall not be liable for damages resulting from unauthorized access caused by factors beyond its reasonable control, including loss of device access or compromise of third-party communication channels.
3. Ophthalmic Lens Calculations and Disclaimer
NexLens Calc provides projected ophthalmic lens calculations based on the information you provide. However, the actual results of lens manufacture may vary depending on the practices, equipment and materials used by the optical laboratory responsible for producing the lenses.
NexLens does not guarantee that the calculations provided by the app will be identical to the results obtained during lens production, as various external factors may influence the final outcome. The app is intended to support professional decision-making, but it does not replace the judgment, measurements and validations of qualified eye care professionals and optical laboratories.
4. Intellectual Property
All rights, title and interest in and to NexLens Calc, including, without limitation, copyrights, trademarks and other intellectual property rights, are the exclusive property of NexLens or its licensors. You are prohibited from copying, modifying, distributing, selling, renting, reverse engineering or otherwise exploiting any part of the application or the content made available within it without the express written authorization of NexLens.
5. Distribution, Purchases and Subscriptions via App Stores
NexLens Calc is distributed through third-party platforms, such as Google Play Store and Apple App Store. Your use of the app may also be subject to the terms of service and policies of these stores.
- All purchases, subscriptions and financial transactions related to NexLens Calc are processed exclusively through Google Play Billing (Android) and Apple In-App Purchases (iOS).
- NexLens does not collect or store your credit card details, bank information or full billing data. Such information is handled solely by Google and Apple via their secure payment systems.
- Any issues related to billing, subscription management, cancellations or refunds must be handled in accordance with the procedures of the respective app store and its terms.
- By making purchases or subscriptions via the app stores, you agree to comply with all applicable terms, rules and policies of Google and/or Apple.
6. Limitation of Liability
To the maximum extent permitted by applicable law, NexLens and its representatives shall not be liable for any direct, indirect, incidental, special, punitive or consequential damages arising out of or related to your use or inability to use NexLens Calc, even if NexLens has been advised of the possibility of such damages.
Your use of NexLens Calc is at your own risk. The app is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including but not limited to warranties of accuracy, fitness for a particular purpose or non-infringement.
7. Indemnification
You agree to indemnify, defend and hold harmless NexLens and its representatives from and against any and all claims, liabilities, damages, losses and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of NexLens Calc; (b) your violation of these Terms of Use; or (c) any violation of third-party rights by you.
8. Changes to the Terms of Use
NexLens reserves the right to modify or update these Terms of Use at any time, without prior notice. By continuing to use NexLens Calc after changes have been published, you agree to be bound by the revised Terms of Use. We recommend that you review these Terms regularly to stay informed of the applicable rules.
9. Suspension and Termination
NexLens reserves the right to suspend or terminate your access to NexLens Calc at any time, without prior notice, for any reason, including but not limited to violation of these Terms of Use or misuse of the application.
In the event of termination, all provisions of these Terms of Use that by their nature should survive, shall remain in full force and effect, including, without limitation, provisions regarding intellectual property, limitations of liability and indemnification.
10. Governing Law and Jurisdiction
These Terms of Use are governed by and construed in accordance with the laws of Brazil, without regard to conflict-of-law principles. Any dispute arising out of or related to the use of NexLens Calc shall be submitted to the exclusive jurisdiction of the Brazilian courts, without prejudice to any rights guaranteed to consumers under applicable local laws.
